1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of thelabillinois.com (the "Site") and any quote, order, or agreement made with The Lab Illinois, a division of Elevated Group ("The Lab Illinois," "we," "us," or "our"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, do not use the Site or place an order.

2. Age Requirement

The Site and its products are intended solely for adults 21 years of age or older. By using the Site, you represent and warrant that you are at least 21 years old and legally permitted to view, purchase, and resell the products described. We reserve the right to refuse service to anyone who cannot verify they meet this requirement.

3. Nature of Products & Buyer Compliance Responsibility

The Lab Illinois supplies bulk hemp-derived cannabinoids, kratom and related botanicals, research peptides, and finished goods manufactured under white label and co-packing arrangements. The legal status of hemp-derived cannabinoid, kratom, kava, and kanna products varies by state, county, and municipality, and changes over time. It is solely your responsibility, as the buyer, distributor, or reseller, to confirm that any product you purchase, possess, sell, or resell is legal in your jurisdiction before placing an order. The Lab Illinois makes no representation that any product is legal in every jurisdiction and accepts no liability for a buyer's failure to confirm local legality.

Research peptides and other research-use compounds sold by The Lab Illinois are sold strictly for laboratory research purposes. They are not approved, labeled, or sold for human or veterinary use, and are not intended for diagnostic, therapeutic, or in-vivo use of any kind. By purchasing research-use products, you represent that you are a qualified purchaser acquiring them solely for legitimate research purposes and that you will not resell, market, or represent them as suitable for human or animal consumption.

4. Wholesale Orders, Quotes & Payment

• Pricing, minimum order quantities, and lead times are provided by quote and are not final until confirmed in writing by a Lab Illinois sales representative.
• Published content on the Site is informational and does not constitute a binding offer to sell at any specific price or quantity.
• Net payment terms are extended at The Lab Illinois's sole discretion to established accounts with a qualifying payment history, and may be modified or revoked at any time.
• Orders are subject to product availability. We are not liable for delays or shortages caused by supply, manufacturing, or shipping disruptions outside our control.

5. Shipping & Delivery

Estimated lead times and shipping windows communicated by your sales representative are estimates only. Title and risk of loss for shipped goods pass to the buyer upon tender to the carrier. Buyers are responsible for inspecting shipments promptly upon receipt and reporting any discrepancy or damage within a reasonable time.

6. Returns, Refunds & Defects

Because products are manufactured, tested, and shipped to order, sales are generally final once an order has been confirmed and produced. If you believe a shipment is defective, mislabeled, or does not match your confirmed specification, contact your sales representative promptly so we can investigate and, where warranted, arrange a replacement, credit, or refund at our discretion.

7. Intellectual Property

All content on the Site, including text, graphics, logos, product photography, and page layouts, is owned by Elevated Group or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from Site content without our prior written consent. Formulas, artwork, and packaging designs developed for a specific white label or co-packing customer remain subject to the terms of that customer's individual production agreement.

8. Prohibited Uses

• Misrepresenting your age, identity, or the intended use of any product you purchase.
• Reselling research-use products as suitable for human or animal consumption.
• Reselling or shipping products into a jurisdiction where they are prohibited.
• Using the Site to transmit unlawful, fraudulent, or harmful content.
• Attempting to interfere with, disrupt, or gain unauthorized access to the Site or our systems.

To the fullest extent permitted by law, The Lab Illinois and Elevated Group will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or related to your use of the Site or any product purchased, even if advised of the possibility of such damages. Our total liability for any claim arising from a specific order will not exceed the amount paid for that order.

12. Indemnification

You agree to indemnify and hold harmless The Lab Illinois, Elevated Group, and their officers, employees, and representatives from any claim, loss, or expense (including reasonable attorneys' fees) arising from your misuse of the Site, your violation of these Terms, or your resale or use of any product in violation of applicable law.

These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Wisconsin.
